Two tracks, two rules. Diagnosis-tied items and services may qualify under IRS §213(d) when a physician issues a Letter of Medical Necessity. Ongoing companion care qualifies only under IRS §7702B(c) — a physician must certify chronic illness (help with 2+ daily activities expected to last 90+ days, or severe cognitive impairment) with a written plan of care. Membership dues are always out of pocket. Eligibility is case-specific and decided by your plan administrator — never guaranteed.
